- General
- Definitions
This Contract is for the hire of items and accessories (“Equipment”) detailed overleaf, and the parties to the Contract are:
- The “Hirer” and, where the Hirer is not an individual acting in person, the “Signatory” on the hire agreement.
- Hottubs North Wales with offices at 7 Grosvenor Avenue, Rhyl, Denbighshire, LL18 4HA, (Referred to as HTNW in this document).
- Any condition deemed invalid will not affect other conditions. Nothing in this contract is intended to limit a consumer’s existing legal rights.
- Extent of Contract and Cancellation
The Contract is not assignable and is effective when HTNW accepts the Hirer’s detailed order. HTNW reserves the right to charge for cancellation.
- Termination
HTNW may terminate the Contract and repossess equipment without affecting any rights to recover monies due, damages for breach of contract or other remedies where the Hirer is in breach or is involved in insolvency or liquidation proceedings.
- Ownership of Equipment and Goods Equipment hired remains the property of HTNW at all times.
- Hire Charges
- Basis of charging
The stated hire charges on the contract are for the duration of the Contract and include Saturdays, Sundays and Public Holidays.
- Transport charges
Delivery and collections including attempted calls are chargeable unless otherwise stated.
- Time for payment and VAT
The Hirer will pay all monies outstanding, including VAT, on demand (interest on amounts overdue is at Lloyds Bank base rate plus 4%) and will be liable for reasonable legal charges incurred by HTNW in the recovery of amounts due, Equipment and/or Goods.
- Deposits
Deposits are set by HTNW at amounts reasonably required and will be offset against monies due. Deposit balances are refunded upon return to HTNW of Equipment in good condition. Balances of deposits paid by cheque will be refunded by cheque issued within 7 business days. Cash deposits are not acceptable.
- Credit and debit card transactions
Where the Hirer has signed a blank credit or debit card voucher, with a subsequent payment shortfall, HTNW may insert and present for payment the balance due. Part payments by credit or debit card may also be processed by HTNW at interim stages of the Contract.
- Loss of Equipment, cleaning and damage repair
HTNW may treat Equipment unavailable for inspection after reasonable notice as lost and levy a penalty charge against the Hirer for Equipment replacement and revenue loss.
The Hirer will pay for required excessive cleaning and any damage occurring deemed outside of reasonable useage.
- Excess Hire Charges will be charged at a rate of £75.00 per day for every additional day or part day that the goods are kept by the Hirer over the agreed hire period unless this delay is caused or agreed to by HTNW.
- Hirer’s Responsibilities
- Inspection and receipt of Equipment and Goods
The Hirer will sign to acknowledge receipt at delivery/handover. Shortages must be agreed and noted on the Contract/delivery document. Equipment defects should be reported to HTNW as soon as possible.
- Delivery/collection of Equipment and Goods
The Hirer will provide adequate delivery and collection access. It is the responsibility of the Hirer to ensure that suitable access is available to get the goods into the property. No refund will be given by HTNW in the event that, on the day of delivery, our engineers cannot get the equipment into the desired location. The Hirer will also ensure that a suitable 240v 13amp supply is available within 2 metres of the spas desired location. HTNW is not responsible or liable for the electricity/power used by the goods during the period of hire.
- Security of Equipment
The Hirer accepts responsibility for Equipment security until its collection by or return to HTNW and undertakes not to sell or relinquish possession, alter, repair or modify it in any way.
- Safe use of Equipment and breakdown procedure
The Hirer is responsible for the safe and correct operation of Equipment (conforming with relevant legislation and the operating and safety instructions supplied) by persons not under the influence of alcohol or drugs and for its constant supervision within the range of children.
The Hirer will immediately notify HTNW of any Equipment breakdown or shortcoming without attempt at repair. The Hirer will ensure any non HTNW equipment used in conjunction with or attached to Equipment also conforms with safety requirements.
- Return or collection of Equipment
The Hirer will make available access for the return of the goods on the pre-agreed day of collection and ensure that a suitable 240v power supply is available for our engineers to use in order to drain the spa.
- Lost or stolen Equipment
Lost or stolen equipment will be charged to the Hirer at the full retail value.
Responsibilities
- Hire rates
HTNW will maintain the agreed hire rates for the duration of the Contract.
- Safety and operating instructions
HTNW will provide appropriate written and/or practical instruction in the safe and correct operation of Equipment. HTNW will also provide suitable spa chemicals to be used during the period of hire, which are the responsibility of the Hirer to keep in a safe place out of reach of children. The Hirer must adhere to the chemical section of the operating instructions.
- Testing and inspection of Equipment
HTNW will comprehensively test all electrical equipment before commencement of hire. Equipment will be inspected and tested where appropriate in accordance with relevant statutory requirements and if Equipment needs to be recovered from the Hirer for such purposes HTNW will substitute items of similar specification.
- Delivery and collection
Delivery and collection will be at the pre-agreed time stated in the hire contract.
- Rental Goods
HTNW will arrange an appropriate credit where necessary.
- Limitation of liability
The liability of HTNW for claims made by the Hirer does not extend to any unforeseeable financial loss caused by late or non-delivery of Equipment and/or Goods, unsuitability, breakdown, stoppage or lawful repossession. Subject to the above HTNW will be liable for negligence or error in the performance of its obligations under the Contract.
Data Protection
The information you provide will be held in accordance with the Data Protection Act 1998 and will be used by HTNW and its trading divisions. We may want to contact you from time to time about other products or services available from us but we will not release your contact details to other carefully selected companies.
